The Kwong Protective Claim Service

A recent federal ruling may entitle you to a refund of IRS penalties and interest assessed between January 20, 2020 and July 10, 2023. Choose the engagement that fits your situation.

Each engagement is a flat fee covering one 1040 or one separately filing entity, with all eligible years 2019–2022 included — no per-year surcharge. A disregarded LLC reported on your 1040 is included in your 1040 engagement. Different 1040s or separately filing entities (S-Corps, C-Corps, partnerships, multi-member LLCs) are separate engagements at the same flat fee.

Honest caveats before you engage

Kwong v. United States is not yet final. The government is expected to appeal, and the decision could be narrowed or reversed. The IRS has not acquiesced and is not issuing refunds proactively.

A protective claim preserves your right to a refund if Kwong is upheld but does not guarantee one. If a refund is ultimately paid, we expect IRS processing to take twelve to thirty-six months. Our engagement scope is limited to the protective filing itself; subsequent IRS correspondence, appeals, and litigation work would be separate engagements at standard rates.
